This Privacy Policy describes how T‑Minus the Day.com LLC (“T‑MinustheDay,” “we,” or “us”) collects, uses, and protects your personal information, including phone numbers and consent for SMS messaging. We are committed to protecting your privacy in compliance with applicable laws, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines.

Information We Collect

We collect personal information you provide directly, such as when you create an account, register for events, or use our services. This includes your name, email address, phone number, and any content you upload (e.g., event details). We and our partners also automatically collect certain information when you visit our website or use our apps, including your IP address, device, and browser information, and information about your activity. Those technologies are described in the “Cookies and Tracking Technologies” section below.

How We Collect, Use, and Share Personal Data

In this Policy, “Host” means the user who creates a countdown; “Collaborator” means a person the Host invites to contribute to it; “Recipient” means the person for whom Memento Cards are created; and “Memento Card” means a message or other content delivered through the Services.

We collect this information directly from you; from Hosts and Collaborators who provide contact information about the people they invite; automatically from your device through the technologies described in the “Cookies and Tracking Technologies” section below; and from our service providers, such as our payment processor and our messaging and email providers.

SMS and Messaging Consent

While using our Sites and Apps, you may agree to receive text messages related to your countdown, including delivery of Memento Cards, order updates, and service notifications, as well as support text messages (e.g., SMS and MMS) from us. By providing your consent (by providing your telephone number pursuant to our consent process, or by initiating a customer service interaction via text), you are agreeing that T‑MinustheDay may send you messages at the mobile telephone number you provide, or from which you initiated the interaction. Consent to receive these text messages is not a condition of any purchase. Msg & Data rates may apply. Message frequency and response rate will vary. We reserve the right to change the phone number from which messages are sent. Not all mobile devices or handsets may be supported and our messages may not be deliverable in all areas. T‑MinustheDay, its service providers and the mobile carriers supported by the program are not liable for delayed or undelivered messages. By consenting to receive text messages from us, you agree to all of our Terms of Use, including but not limited to the Arbitration Agreement (Section 18). You also acknowledge that you have read and acknowledge our Privacy Policy. We are able to deliver messages to all major mobile phone carriers.

Information from User-Provided Contacts

When you create events, countdowns, or collaborations (e.g., surprise birthday cards or invites), you may provide us with contact information for recipients, such as phone numbers. We collect and retain this information solely to facilitate the Services, such as sending transactional SMS notifications related to the event (e.g., invites, reminders, or updates). We require that you obtain explicit prior consent from each recipient before sharing their contact information with us. By providing a recipient’s phone number, you warrant and represent that you have obtained the recipient’s express permission to share their phone number with T‑MinustheDay and for them to receive transactional SMS messages from us related to the event. This consent must be based on a prior relationship (e.g., friends or family) and is specific to this campaign—it is not transferable or assignable to other services, campaigns, or third parties. If you do not have such consent, you must not add their phone number or send messages to them via the Services. We do not use recipient contact information for our own purposes without their direct, explicit permission (e.g., if they later create an account with us and opt in separately).

How We Use Your Information

We use your information to provide and improve our Services, including sending transactional SMS notifications (e.g., event reminders, invites) based on your explicit opt-in or user-provided contacts with warranted consent. We also use information for advertising and measurement. We do not sell or rent your personal information. We share information with service providers (e.g., messaging carriers like Twilio) to deliver the Services, subject to confidentiality obligations, and with our advertising partners (e.g., Pinterest, Meta, Google, and ByteDance) for advertising and measurement as described in the “Cookies and Tracking Technologies” section below.

Cookies and Tracking Technologies

We and our partners use cookies, web beacons, pixels, tags, embedded scripts, and similar identification technologies on our website and apps.

These technologies automatically collect information about your device and your activity, including your IP address, browser and device identifiers, the pages you view, and the actions you take (such as creating an account, building a countdown, submitting a countdown for approval, and completing a purchase).
In addition, when you submit our signup form, third-party advertisers use a tag that collects your email address, phone number, and first name in encrypted (hashed) form, and sends them to the relevant third party (e.g., Pinterest, Meta, Google, and ByteDance). These third parties may store identifiers in your browser that are associated with the pages you visit afterward.

We use this information to advertise T‑MinustheDay and to measure how our ads perform. Our advertising partners, such as Pinterest, Meta, Google, and ByteDance, operate independently of us: they may use the information they receive in a personally identifiable way, may link it to any account you already have with them, and may use it for their own purposes, including showing you ads on their own and other services. As a result, third parties may collect information about your online activity over time and across different websites when you use our Services.

You can limit or block cookies or similar technologies through your browser settings. You can also adjust your ad personalization settings in your Pinterest, Meta, Google, and ByteDance account settings and opt out of interest-based advertising from participating companies at optout.aboutads.info.

For SMS Messaging

We send messages only to opted-in users or recipients with warranted prior consent. Consent is campaign-specific and not a condition of purchase or other services. We may retain consent records (e.g., timestamps, IP addresses) as required by law and will provide them upon request for compliance verification.

Opt-Out and Cancellation

You or any recipient can revoke consent at any time. Text the keyword STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE to our longcode to cancel. After texting STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE to our longcode you will receive one additional message confirming that your request has been processed. If you unsubscribe from one of our text message programs, you may continue to receive text messages from T‑MinustheDay through any other programs you have joined until you separately unsubscribe from those programs. We will also honor requests made by email to info@tminustheday.com or by phone at 1‑888‑559‑6496, and we will process any request promptly and in no event more than ten business days after we receive it.

Data Retention and Security

We retain personal information, including phone numbers and consent records, only as long as necessary to provide the Services or comply with legal obligations (e.g., at least five years after the last message sent to you, and longer where required to resolve a dispute or comply with legal obligations). We implement reasonable security measures to protect your data from unauthorized access.

Service-Specific Additional Terms — Mobile Apps

Before using any of our mobile applications (“App” or “Apps”), we may ask you to install a valid copy of the App on your mobile device, register for an account, input your account information into the App as requested, and meet certain hardware and connection requirements which may change as the App evolves. You are responsible for any internet connection fees and/or mobile carrier charges that you incur when accessing or using an App. Should you uninstall an App from your mobile device, you may not be able to use all or some of the features of the App. We use reasonable efforts to accurately display the attributes of any photographs in products that you order through an App, including the colors of those photographs; however, the actual color you see is dependent upon your mobile device, and we cannot guarantee that your mobile device will accurately display such colors.

Custom Design Services

T‑MinustheDay may offer you the opportunity to engage with our designers (“Custom Design Services”) to create a Custom Design for a specific product (“Custom Designed Product”). By using the Custom Design Services, you agree you are solely responsible (pursuant to Section 1 of these Terms) for the materials you submit to us for the Custom Designed Product. You grant us a fully paid, worldwide, non-exclusive right and license to use your owned or licensed copyrights, logos, insignia, trademarks, and other artistic designs contained in the specific materials submitted to us for the purpose of providing the Custom Design Services and the Custom Designed Product. You continue to own and retain all rights, title and interest in and to your trademarks, copyrights and other intellectual property contained in the Custom Designed Product. We will own and retain all rights, title and interest in and to the final Custom Design and the Custom Designed Product. We will grant you a fully-paid, worldwide, non-exclusive right and license to use the Custom Designed Product, provided you have paid for the Custom Design Services in full. You are not obtaining any intellectual property rights from us in the final Custom Design or the Custom Designed Product. You may request the Custom Design be applied to any of our current product offerings. For other products, we may provide you with an electronic version of the Custom Design for your personal use, subject to our sole discretion, and an additional fee will apply. If you would like to make changes to your Custom Design or Custom Designed Product, our customer service representatives are available to assist you.

T‑MinustheDay may ask that you authorize us to use certain content or posts (including photos or videos) uploaded to your social media profile(s) (“Post(s)”), as detailed herein. By agreeing to these terms by responding to T‑MinustheDay’s request with the hashtag “#YesTMinustheDay,” you hereby agree to these Terms of Use and grant to us and our licensees, designees, successors, agents, and assigns (collectively, “Permitted Parties”) the non-exclusive, transferable, sub-licensable, perpetual, irrevocable, royalty-free, fully-paid up right and license to use, publish, transmit, reproduce, copy, and adapt the Post(s), as well as your username, name, picture, likeness, social media handle, caption, comments and statements in connection with any use of your Post(s) (which all, collectively, shall be defined with the Post(s) as “Social Media Submission(s)”), edited or altered as the Permitted Parties see fit, throughout the world, including but not limited to on Permitted Parties’ social media platforms, in-app content, and on other domains, properties, or websites owned or licensed by the Permitted Parties, for any lawful purposes, including, without limitation, for purposes of advertising or trade and you waive any applicable moral rights you may have under the laws of the jurisdiction in which you reside, in and to the Post(s), in favor of the Permitted Parties. You understand that Permitted Parties shall be under no obligation to exercise the rights granted herein.

You agree and represent to us (i) that you are the sole author of the Social Media Submission(s); (ii) if the Social Media Submission(s) include any photos, you are the photographer of the photos or you have secured the rights from the photographer necessary to allow you to grant the rights granted herein; (iii) if the Social Media Submission(s) include any photos of people, you have permission from each person who appears in the Social Media Submission(s) to grant the rights granted herein; (iv) the use of the Social Media Submission(s) as permitted hereunder will not violate or infringe upon the rights of any party or violate any law; (v) you have the full and exclusive right and authority to agree to the terms hereto; and (vi) you are eighteen years old or older. You also certify that any statements made by you in the Social Media Submission(s) reflect your honest opinions, findings, beliefs or experiences.

Your California Privacy Rights

As a California resident, you may have the rights listed below in relation to personal information that we have collected about you. However, these rights are not absolute, and certain exceptions apply. In certain cases, we may decline your request as permitted by law.

  • Right to Know. You have a right to request the following information about our collection, use and disclosure of your personal information:
    • categories of personal information we have collected, disclosed for a business purpose, or shared;
    • categories of sources from which we collected personal information;
    • the business or commercial purposes for collecting and/or sharing personal information;
    • categories of third parties to whom the personal information was disclosed for a business purpose, or shared; and
    • specific pieces of personal information we have collected.
  • Right to Delete. You have a right to request that we delete personal information we maintain about you.
  • Right to Correct. You have a right to request that we correct inaccurate personal information we maintain about you.

You may exercise any of these rights by contacting us using the information provided below. We will not discriminate against you for exercising any of these rights. We may need to collect information from you to verify your identity, such as your email address, government issued ID or date of birth, before providing a substantive response to the request. You may designate, in writing or through a power of attorney document, an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us.

Residents of Other U.S. States

If you are a California resident, please see the section above, Your California Privacy Rights, for information on your rights in relation to information that we have collected about you. If you are a resident of another U.S. state, depending on the state you live in, you may have some or all of the rights listed below in relation to information that we have collected about you. However, these rights are not absolute, and certain exceptions apply. In certain cases, we may decline your request as permitted by law, including in the event you reside in a state that does not currently grant you these rights.

  • Right to Access. You may have a right to request that we confirm whether we process information about you and give you access to that information in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the information to another business without impediment.
  • Right to Correct. You have the right to request that we correct inaccurate personal information that we maintain about you.
  • Right to Delete. You have the right to request that we delete the personal data we have collected about you.
  • Right to Object to Targeted Advertising, Profiling, or Selling. You have the right to opt-out of the processing of your personal information for the purposes of targeted advertising, the sale of your personal information, and/or the profiling of your personal information in furtherance of decisions that produce legal or similarly significant effects (as all such terms and concepts are defined under applicable law). We will not discriminate against you for exercising any of these rights. We may need to collect information from you to verify your identity, such as your email address, or date of birth, before providing a substantive response to the request. Depending on your location, you may designate, in writing or through a power of attorney document, an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us.

In addition, you may have the right to appeal our decision regarding a request related to these rights by contacting us using the information provided below. When you submit a request or launch an appeal, we will limit our collection of your information to only what is necessary to securely fulfil your request or process your appeal. We will not require you or your authorized agent to pay a fee for the verification of your request or appeal.

Children’s Privacy

Children under the age of 18 are not permitted to use the Services, and we do not seek or knowingly collect any personal information about children under 13 years of age. If we become aware that we have unknowingly collected information about a child under 13 years of age, we will make commercially reasonable efforts to delete such information from our database. If you are the parent or guardian of a child under 13 years of age who has provided us with their personal information, you may contact us using the below information to request that it be deleted.

Changes to this Policy

We may update this policy from time to time. If we make material changes, we will post the updated policy with a new effective date and notify account holders by email.
